The Cercle Yves Caron was established in 2012 on the initiative of Professor Roderick A. Macdonald andÌýunder the sponsorship of the Paul-André Crépeau Centre for Private and Comparative Law. The purpose of the Cercle is to provide a vehicle by which the community of scholars teaching and researching in the field of secured transactions law (sûretés réelles et personnelles) may recognize those of their peers who have made a lifetime contribution to the advancement of this field of Quebec civil law.

The Cercle takes the name of Yves Caron, notary and long-time professor of law at ÎÛÎÛ²ÝÝ®ÊÓƵ University. Yves Caron taught and published several articles in the field of secured transactions during a distinguished career at ÎÛÎÛ²ÝÝ®ÊÓƵ. For a decade in the late 1960s and 1970s, Professor Caron also served as Vice-Chair of the Civil Code Revision Office, which was itself under the Chairmanship of Professor Paul-André Crépeau. Professor Caron was also the Chair of various sub-committees of the CCRO, most notably the Committee on Security on Property.

Nominations

Membership in the Cercle is open to professors and sessional lecturers in law faculties in Quebec who have made a lifetime contribution to the advancement of the field of secured transactions law in Quebec.Ìý To be eligible for nomination, candidates meet the following criteria.

(a) Candidates must be, or have been, either full-time professors or sessional lecturers at law faculties in Quebec.

(b) Candidates must be recognized for their teaching and research in the field of secured transactions.

(c) Candidates must have taught the subject for at least twenty years.

(d) Candidates must have retired from full-time teaching or have reached normal retirement age.

Any professor may nominate any other professor (including himself or herself) for membership in the Cercle.ÌýÌý Deans may also propose nominations to the Cercle. Nominations must be received by the Centre Paul-André Crépeau by the 15th of October in the year in which a candidate is being proposed for membership.Ìý Any professor or sessional lecturer who has been nominated shall be consulted by the organizer of that year’s Annual Colloquium as to whether he or she wishes to accept the nomination. The administration of the Centre will then arrange with candidates who accept the nomination to prepare the appropriate certificate of membership. This certificate will be presented to new members of the Cercle at the Annual Colloquium of secured transactions law professors each autumn.

On November 30, 2012, during the 10th Annual Colloquium of secured transactions law professors, Louis Payette, Jacques Auger, Robert Godin, Louise Poudrier-LeBel and Pierre Ciotola became the first professors to be named to the Cercle Yves Caron.

On November 15, 2013, during the 11th Annual Colloquium of secured transactions law professors, Marc Boudreault, Charles Belleau, and Jacques Deslauriers (who, regrettably, was absent from the event) were inducted to the Cercle Yves Caron.

On November 28, 2014, for the 12th Annual Colloquium of secured transactions law professors, it was decided that the award would given posthumously to Professor Roderick Macdonald, who was so instrumental in setting up the Cercle. It was presented to his widow, Ms. Shelley Freeman, by Lionel Smith, former director of the Paul-André Crépeau Centre.
